Terms of Use

The Service
The WiFi internet access service (the "Service") is provided to you by Innov@te. By using the Service you agree to abide by the terms and conditions below (the "Terms"). If you do not agree to all of the Terms, please do not use the Service. So that we can allocate a password to you, enabling you to use the Service, you consent to providing personal data; we will use this data to monitor compliance with the Terms, to prevent and detect crime and to monitor usage of our WiFi Network.
 
1. Our Obligation
  We will use our reasonable endeavours to make the Service available 24 hours a day, however we will not be liable if for any reason the Service is not available at any time or for any period. Access to the Service may be suspended at any time.
 
2. Your Obligations
  2.1. You will keep confidential any access codes or passwords provided to you in order to access the Service, and will not disclose them to any other person for any reason. You will be responsible for any loss that arises from you losing, misusing or otherwise disclosing any such access codes or passwords. If you lose any such access codes or passwords, you should contact the innov@te text advice line on the number provided.
  2.2. You shall assume total responsibility for all content distributed, accessed, or viewed while connected to the Service. Under no circumstances shall we be held liable for your actions while you are using the Service. In the event of a court order, we may provide any and all information that they request.
  2.3. The Service is intended to allow you to access the internet in order to use, amongst other things, the worldwide web, e-mail and messaging services. You undertake to us that your behaviour while using the Service will at all times be lawful, honest and appropriate and you accept that we may suspend or disconnect your access to the Service without giving reasons.
  2.4. In particular you will not:
    2.4.1. use the Service to transmit, retrieve or display any kind of pornographic, offensive, defamatory or illegal material, or for any illegal purpose and we will co-operate with any law enforcement authority to prevent, detect and pursue offenders and suspects;
    2.4.2. access or attempt to access the Service via more than one device or via access granted to another user;
    2.4.3. use the Service in such a manner as to host a web or other server, send or facilitate the sending of bulk e-mail or collect third party personal data without appropriate consent;
    2.4.4. knowingly disable, access or overload any computer system or network or circumvent any system intended to protect the privacy or security of another user;
    2.4.5. resell, or attempt to resell, the Service to any third party; and/or
    2.4.6. exceed the download or any other limitations relevant to the Service provided to you.
  2.5. You must not use the Service to deliberately or carelessly propagate any virus, worm, Trojan horse, or other malicious program code (including spam) and you must take reasonable steps to ensure that your device is free of all viruses and that your firewall is operational, before connecting to the Service.
  2.6. Any copyright images, material, software or files downloaded via the Service may only be used in ways that are consistent with the related licences and you must not use the Service to download, upload or distribute copyright material (music, films etc.) in violation of applicable licences or copyright law.
 
3. Failure to Comply With Terms and Conditions
  We shall investigate any suspected breach of the Terms by you, and reserve the right to take such action as we, in our sole discretion deem appropriate, including suspension or withdrawal of the Service and denying you access to all or part of the Service with immediate effect and without notice to you.
 
4. Disclaimer
  4.1. You acknowledge that your use of the Service is at your own risk. We provide the Service as a facility for you on an "as-available" basis, and to the fullest extent permitted by law, we exclude all and any warranties or conditions of any kind in respect of the Service and any content or data obtained or downloaded from it.
  4.2. Information transmitted through us and through the internet in general is not confidential. If you are concerned about the transmission of sensitive information, you must use your own encryption/decryption software, as we do not guarantee the security of data transmitted when using the Service. We cannot and shall not guarantee privacy or protection of any user. We reserve the right to monitor your transmissions when deemed necessary for providing proper service and/or to protect the rights and property of our company.
 
5. Liability
  5.1. Nothing in these Terms excludes or limits the liability of either of you or us for death or personal injury.
  5.2. Subject to paragraph 5.1, under no circumstances shall we, our agents, or employees be liable to you in contract, tort or otherwise arising in connection with use of the Service for any damages which result in any way from your use or your inability to use the Service or any part thereof. This includes all direct and indirect damages, special, punitive or economic losses (including, without limitation, loss of revenues, profits, contracts, business or anticipated savings), any loss of goodwill or reputation, any special, indirect or consequential losses or any destruction or loss of data.
  5.3. You will indemnify us against all and any losses or claims arising from any breach of the Terms by you, and against any claims or legal proceedings arising from your use of the Service which are brought or threatened against us by another person.
 
6. General
  6.1. We reserve the right to amend these Terms at any time.
  6.2. You acknowledge and agree that all intellectual property rights (including, but not limited to copyrights (including rights in software), trade marks, database rights, patents and inventions) in and relating to the Service are owned by us and our licensors or contractors. Nothing in these Terms operates to transfer any such intellectual property rights to you.
  6.3. These Terms are governed by the laws of England and we and you hereto submit to the non-exclusive jurisdiction of the English courts.
